Legal Officer Job in Kenya

Vacancy: Legal Officer
 
Overall Purpose: Reporting to the Chief Operating Officer, the Legal Officer will be responsible for handling perfection of Legal / Credit documentation relating to approved facilities by providing high level quality support to credit division, business teams, and related units. 

The position also provides legal services to the Company in drafting and interpretation of legal instruments, interpretation of various statutes & regulations and give legal opinions on diverse issues. 

Key Responsibilities:
  • Issuance and processing of Facility Letters upon receipt of duly approved Credit Approval, while observing turn-around time and high standards of accuracy.
  • Ensure appropriate security documentation on the Institution’s standard forms have been properly prepared before dispatch to the customer.
  • Instructing the Institution’s external Lawyers on securities documents to prepare, perfect and register at the various Land and Company registries. Performing liaison role between the functions of the Institution and the lawyers, professional valuers and insurance companies approved by the Institution, ensuring service level agreements agreed are adhered to.
  • Liaising with the external legal counsel and other service providers on security documentation process and ensuring that security documentation and other conditions of sanction have been perfected prior to authorizing the drawdown of facilities.
  • Liaising with the Branch Managers on all outstanding approval conditions and answering all queries relating to pending compliance certificates.
  • Management of legal due dilligence and liaising with external legal counsel on all legal matters relating to the company.
  • Drafting standard contracts, specialised contracts and correspondences on legal matters, reviewing and negotiating contracts to which the company is a party. Ensuring that all such contract documents and third party contracts are promptly executed.
  • Preparing legal cases in conjunction with the external counsel, monitoring progress to ensure prompt resolution of all disputes, follow up on court cases facing the company and attend court hearings on behalf of the company whenever arises.
  • Handling redemption and takeover of facilities from and to other financial institutions and ensure terms and conditions of undertaking are in our favor and are strictly adhered to.
  • Keeping abreast with legal and policy developments and providing updates and advice to management on compliance.
  • Ensure legal and other security documents are properly kept and secured.
  • Providing legal advice to the management including reviewing legal documentation.
Minimum qualification and experience required:
  • Bachelor’s degree in Law (LLB) from a reputable University.
  • Post-graduate diploma in Legal studies from the Kenya School of Law.
  • Be of good standing and possesses a current LSK practising certificate.
  • An Advocate of the High Court of Kenya.
  • Minimum two (2) years’ post admission experience in providing legal services preferrably Conveyancing and Commercial Law in a reputable institution/legal firm.
  • Demonstrates good grasp of relevant laws including but not limited to Laws governing the Constitution of Kenya 2010; Labour Laws and Corporate Governance.
  • Have excellent interpersonal, negotiation, communication, analytical, organisational and people skills.
  • Sound understanding of lending in the microfinance industry in Kenya.
  • At least two years expericnce in credit documentation and excellent facilities drafting skills.
  • Ability to prioritise work and deliver high quality output within tight deadlines.
  • High follow though ability.

Job Objective: To provide technical/programmatic and administrative support to the Chairpersons office.

Description of key duties
 
The main tasks performed by the job holder.
  • To provide comprehensive, confidential and high quality technical and administrative service to the Chairperson;
  • Assisting the chairperson in their day to day programmatic and engaging in research into various human rights concerns and/or emerging issue of local, regional and international concern related to the chairpersons’ work as well as drafting and advice on redress options;
  • Preparing speaking notes, legal briefs, opinions and insights for the chairpersons’ engagements;
  • Preparation of concept papers, intervention strategies and proposal writing for various activities;
  • Coordinating and facilitating meeting mundane to the Chairpersons work;
  • Assist in providing analytical  advice on and implementation  of  appropriate redress mechanisms;
  • To manage and prioritize all communications to the chairs office at all times and ensure adherence to deadlines in response;
  • Any other duty as may be assigned from time to time.
Minimum Requirements
  • A Bachelors Degree in Law and an Advocate of the High Court of Kenya
  • At least three years work experience in an equivalent and similar level and position
  • Good skills on Complaints handling and investigations with a good understanding of human rights
  • Good Interviewing and report writing skills
  • Good organizational, writing, interpersonal (people management), communication and analytical skills
  • Sound Knowledge and understanding of local and International Human Rights instruments and the Constitution.
  • A good team player who is results oriented, has attention to detail and is client focused
  • Computer literacy, ability to work in stressful and demanding environments.
  • Fluency in spoken and written English and Swahili.

Key duties and responsibilities:
  • Provide leadership in and guide the conceptualization, planning, implementation, monitoring and evaluation of the work of the Northern Kenya Regional Office
  • Coordinate implementation and management of the complaints handling process, investigations and other key areas of work as stipulated under Section 8 of the KNCHR Act, 2011 and as may relevant to the Northern Kenya Region
  • Prepare and present quality and timely monthly, quarterly and annual reports of the work of the Regional office, including reports of financial expenditure by the Regional Office
  • Manage and supervise all staff of the Regional Office, including management of financial resources and fixed assets
  • Ensure compliance with the policies of the Commission in the running of the Regional Office
  • Ensure proper flow of information and communication between the Head Office and the Regional Office, as well as with other Regional Offices.
  • Build and maintain sustainable partnerships with both state and non state actors in the region on behalf of the Commission
  • Any other duties as may be assigned from time to time.
Qualifications and Experience
  • A Masters degree in a Social Science from a recognized institution with five years experience in a busy programme-related environment

  • A Bachelors Degree in a Social Science from a recognized institution with seven years experience in busy programme-related environment.
In addition the suitable candidates for the above position should possess the following skills and attributes:-
  • Good understanding of human rights.
  • Good organizational, writing, interpersonal, communication, people management, analytical and presentation skills.
  • Must be willing to travel the vast terrain covered by the region hence flexible and adaptable.

Mediation Services for Association of Kenya Credit Providers Alternative Dispute Resolution (ADR) Centre


Financial Sector Deepening (FSD) Kenya is collaborating with the Association of Kenya Credit Providers (AKCP) to set up an Alternative Dispute Resolution Centre for the Credit Information Sharing (CIS) mechanism. 

Applications are invited from qualified persons for expression of interest in providing Mediation Services for the CIS ADR Centre.

Functions
  • To receive and enquire into complaints relating to information shared by credit providers through credit reference bureaus (CRBs);
  • To investigate complaints against members of the Association;
  • To liaise with the disputants and the Associations’ Secretariat to organize forums for mediation;
  • To promptly mediate and effectively resolve CIS disputes;
  • To meet set turn-around time in mediating the disputes;
  • To analyse the disputes before it and come up with trends that can be used to improve the CIS mechanism; and,
  • To undertake any other functions that may be assigned by the governing council in relation to credit information sharing disputes.
For appointment to the position of ADR CIS Mediators, the applicant must possess the following minimum qualifications:

  • ƒHold an appropriate degree from a recognized university;
  • Have at least three years’ experience as an ADR practitioner and particularly mediation;
  • Meet the requirements of Chapter Six of the Constitution and be of high moral character, integrity and impartiality; and,

Qualifications:
  • At least a grade C+ at K.C.S.E;
  • At least 5 years experience in a busy law firm or a legal organization;
  • Must be computer literate;
  • Satisfy the requirements of Chapter Six of the Constitution of Kenya;
  • Being a licensed court process server shall be an added advantage.

Duties and Responsibilities
 
1. Acts as the Board Deputy Secretary:
 
Deputises the Board Secretary to:
  • Organize and coordinate Board meetings.
  • Circulate preliminary notices and agendas for Board meetings in consultation with Board Chairman and Secretary.
  • Ensure Board files are compiled and dispatched to Members before meetings are held.
  • Maintain and distribute accurate minutes of the Board meetings to the Members.
  • Ensure that resolutions and action points from Board meetings are circulated to affected County Ministries or individuals within the stipulated timeframe.
  • Record proceedings of Board retreats and other external meetings
  • Be the custodian of the Board’s records
  • Make regular reports for submission to the County Assembly on the execution of the Boards functions
2. Functions as Secretary of various Board Committees to:
  • Circulate preliminary notices for meetings of committees of the Board, in consultation with respective Committee Chairpersons.
  • Ensure Board Committee files are compiled and dispatched to Members before meetings are held.
  • Maintain and distribute accurate minutes of the Committee meetings to Members.
  • Ensure action points from Board committee meetings are circulated to the relevant County Ministries or individuals and responses received for tabling to the full Board.
3. Legal Counsel functions:
  • Proactively guide the Board on all legal matters affecting its functions
  • Ensure adherence and compliance to legislation, including subsidiary legislation in the form of Rules, Gazette notices, Regulations etc relating to CPSB functions.
  • Advise on Agreements, contracts and other Board commitments.
  • Review the Board’s legal documentation e.g. letters of offer or any other security documentation to ensure the Board’s interests are well protected.
  • Proactively review any changes in legislation, thereafter forwarding the same regularly in the form of legal updates to the Board for information, action and compliance.
  • Appearing as a witness where matters related to the Board are contested in court
4. Secretariat Functions:
  • Be the accounting officer of the CPSB to oversee the management of finances, preparation and submission of the board’s annual plans, programmes estimates and budgets
  • Facilitating the recruitment process in Kitui County and Preparing guiding notes to the Selection Board
  • Supervise, plan, assign, monitor and appraise the work of the Secretariat staff
  • Processing promotions and acting appointments of county public officers
  • Preparing briefs on disciplinary cases received in the county and tabling them before the Board decision making
  • Preparing briefs on appeals and applications for review to be considered by the Board
  • Assist the Board in enhancing its Corporate Governance Policy and ensuring compliance throughout the County.
  • Maintain custody and control of the Board’s statutory books, minute books, various registers/records and the Board seal.
  • Reviews and updates the Board’s website and manuals as necessary.

Concern Worldwide Public Participation Legal Consultant Job in Marsabit Kenya

Concern Worldwide is a non-governmental, international humanitarian organization dedicated to the reduction of suffering and working towards the ultimate elimination of extreme poverty in the world’s poorest countries.

Applications are invited from suitably qualified candidates for the following position:
 
Position: Legal Consultant - Public Participation
 
Location: Marsabit County with frequent travel to Nairobi
 
Duration: Three (3) Months
 
Background: The Constitution of Kenya provides for a devolved system of government whose main object, inter alia, is to provide the powers of self-governance to the people, and enhance their participation in the exercise of the powers of the State and in making decisions affecting them. 

Given that formal public participation is without precedent, the development and adoption of appropriate standards for citizen participation is a critical first step towards citizens’ realization of the right to participation and the powers of self-governance. 

Moreover, the challenges present in the Arid and Semi-Arid Lands necessitate new and innovative methodology to enable participation for all. 

It is for this reason that Concern Worldwide is supporting the County of Marsabit to establish appropriate mechanisms for citizen participation, as required by the County Governments Act 2012, through a grant from UK Aid.

Objectives & Scope of the Consultancy: The consultant will provide technical legal assistance including advisory, policy and legislative drafting and research services to the Marsabit County Government for the development of a Public Participation Bill and Policy.

Expected Outputs / Deliverables:
 
The consultant will report to Concern Worldwide and will be based in Marsabit County with frequent travel to Nairobi. 

This assignment will be for ninety (90) work days and the consultant is expected to deliver:
  • An inception report, including a commented outline and a list of existing information (10-15 pages)
  • Bi-weekly progress reports
  • A report of public consultations
  • A draft public participation legislation
  • A draft policy document on public participation
Consultant’s Profile or Qualifications:
  • Bachelor of Laws Degree (Masters degree preferred)
  • An advocate of the High Court of Kenya
  • 7 years’ experience with at least 5 years proven track record in legal drafting
  • In-depth knowledge of the Constitution of Kenya and Statutes on Governance and Devolution
  • Significant experience in community mobilization, facilitating and documenting stakeholder consultations
  • Familiarity with and/or working in ASAL areas with pastoralist communities will be an added advantage
  • Proven research and report writing skills and excellent people and communication skills
